Rule 58A-5.023(4)(c), F.A.C. states: "(c) Resident bedrooms designated for multiple occupancy in facilities newly licensed or renovated 6 months after 10-17-99, shall have a maximum occupancy of two persons. Resident bedrooms designated for multiple occupancy in facilities licensed prior to 10-17-99, shall have a maximum occupancy of four persons.
Rule 58A-5.0131(23), F.A.C. states: "Newly licensed" means a new facility which is licensed for the first time. The term does not apply to an existing facility that has undergone a change of ownership."
Section 408.803 (5), F.S. defines a change of ownership (CHOW), which states: "Change of Ownership" means an event in which the licensee changes to a different legal entity or in which 45 percent or more of the ownership, voting shares, or controlling interest in a corporation whose shares are not publicly traded on a recognized stock exchange is transferred or assigned, including the final transfer or assignment of multiple transfers or assignments over a 2-year period that cumulatively total 45 percent or greater. A change solely in the management company or board of directors is not a change of ownership."
For ALF's that designate a wing or certain beds as Independent Living: Chapter 58A-5.024(3) (0), F.A.C. states:
“For apartments, duplexes, quadruplexes, or single family homes that are designated for independent living but which are licensed as assisted living facilities solely for the purpose of delivering personal services to residents in their homes, when and if such services are needed, record keeping on residents who may receive meals but who do not receive any personal, limited nursing, or extended congregate care service shall be limited to the following:
A log listing the names of residents participating in this arrangement;
2. The resident demographic data required under this subsection;
3. The medical examination described in Rule 58A-5.0181, F.A.C.;
4. The resident’s contract described in Rule 58A-5.025, F.A.C.; and
5. A health care provider’s order for a therapeutic diet if such diet is prescribed and the resident participates in the meal plan offered by the facility."
